ACMA Seeks Two Key Congressional Provisions in Wake of SCOTUS Ruling
The American Catalog Mailer's Association released the following statement on Nov. 26, 2018:
Dear Industry Member:
It’s the lame duck and...it is now or never. We’re down to the wire on having any chance of getting action on our vital asks of Congress for "must pass" legislation in the Lame Duck session. But it will only happen if Republican members of the House reach out to Speaker Paul Ryan’s office this coming week requesting commonsense relief in the wake of the Supreme Court’s overturn of the Quill physical presence standard.
The best we can do at this point is to get our two most urgent asks tacked on to a piece of moving legislation before the 115th Congress adjourns sometime next month.
These are our two asks, both of which are reasonable and noncontroversial:
1. Prohibit any retroactive sales tax liability prior to a reasonable effective date, and
2. Provide for an orderly phase-in period so remote sellers can be fully compliant with a myriad of diverse tax regulations.
What You Need To Do Right Away
In every location where you have both employment and Republican Member(s) of the House of Representatives, get in touch with their Washington and local offices to pass along this message:
• Our two asks from above, and
• Your request for their office to tell Speaker Ryan (via an email to
casey.higgins@mail.house.gov) these two provisions are very important to their constituents.
To find your congressperson’s contact details, search for their official website and scroll to the bottom of the page where you’ll find the main phone number. Call that number and ask for the congressman’s staffer that handles tax matters. Then either speak with that person or obtain his or her email address and send a message. Early next week we need a widespread outreach if this is going to happen.
ACMA will be working closely with the 116th Congress to make some suggested simplifications necessary to preserve a free and open marketplace across the land, but right now we need these two things, as it will be too late in 2019.
Also Worth Trying
Encourage your employees to reach out to their local congressmen if they’re concerned that they have a job in the future. Encourage your suppliers to reach out, as reductions in your purchases will impact their employment too. We must have a broad and widespread effort if we are to make this happen. It can happen, but only if you act.
