On December 29, APCO filed a Petition for Reconsideration with the FCC regarding the rules on 4.9 GHz that were adopted by a spilt vote in September. As background, public safety entities previously had exclusive access to a block of 4.9 spectrum, which supports broadband communications. The ill-conceived new rules strip the 4.9 GHz spectrum from public safety and allow states to lease access to the spectrum to commercial users. APCO pointed out that the adopted approach was not adequately presented as a possibility during the rulemaking process and ignores alternative approaches, which would promote public safety and increase use of the band.
