Hurricane Irma has created several issues with gasoline markets in Florida, both by prompting increased demand and disrupting the supply chain needed to deliver gasoline. Hurricane Irma made landfall in South Florida on September 10 and proceeded on a northwesterly path up the length of the state. Because of the evacuation of people in anticipation of Hurricane Irma, demand for transportation fuels and the logistical challenges in supplying Florida began before it made landfall. As Hurricane Irma approached, shipping traffic was diverted and ports closed, stopping the flow of petroleum products into Florida. People filling their gasoline tanks in anticipation of the storm resulted in a rapid increase in demand. Joel Fox, editor and co-publisher of Fox and Hounds Daily, commented on the effort to repeal the gas tax passed in April and the political implications it could have. He reports that anger over the increase in gas taxes has launched a second initiative to repeal the tax and that sources close to the drafting of this new measure say it will be well funded. Such a measure could have political implications beyond undoing the tax—one situation now and one if it makes the ballot.
A job killer bill mandating a new protected leave of absence for small businesses passed the Legislature this week and is on its way to the Governor. SB 63 (Jackson; D-Santa Barbara) passed the Assembly on September 12 by a vote of 51-15. A day later, the Senate voted 25-13 to concur in Assembly amendments to the bill, sending the bill along to the Governor. The California Chamber of Commerce and a coalition of business groups and local chambers of commerce have been opposing SB 63 because it unduly burdens and increases costs of small employers with as few as 20 employees by requiring 12 weeks of protected employee leave for child bonding. It also exposes employers to the threat of costly litigation.
The California Chamber of Commerce's Alert newsletter recently reported that a California Chamber of Commerce-opposed job killer bill that provides the perfect pleading pathway for class action attorneys to avoid arbitration has passed the Legislature and is on its way to the Governor. SB 33 (Dodd; D-Napa) will negatively impact employers with unnecessary and costly class action litigation that benefits trial attorneys, not consumers. The bill passed the Assembly on September 5, 46-23. The Senate concurred in Assembly amendments a day later, 25-13.
In a recent article on Fox and Hounds Daily, Loren Kaye, president of the California Foundation for Commerce and Education, reported on pending legislation in California's Senate that would regulate California's Internet service providers. Kaye recognizes that consumers are rightfully concerned about data security and personal privacy. Data breaches, hacking and poor personal security practices have compromised internet users’ financial and personal information. Large majorities of Americans want to improve their control over their own personal information. However, he thinks a "California-only approach" to enforce data a privacy regime is the wrong approach.
