Guy Rents, Inc. dba Rental Guys, a Chico, CA-based equipment rental company has closed a transaction to acquire the assets of Orangevale, CA-based Greenback Equipment Rentals, Inc. The Orangevale location, near Folsom, CA, will be Rental Guys’ ninth Northern California location. CEO Alex DuBose said, “The new location complements our existing footprint as we continue to grow in the rural markets of Northern California. We will be investing significantly in new rental fleet in the location that serves the eastern foothill suburbs of Sacramento County.” Jerry and Vickie Culbertson, owners of Greenback said “We had many offers, including some from large companies, but felt Alex and his family-owned business was the best fit for our employees.”Jerry, Vickie and their son Brian who managed the store, would like to thank their customers and employees for their loyal support over the years. During the pandemic, insurance laws in many states are allowing employers to reclassify employees who normally work in higher rated workers comp classes as clerical or other lower classifications. Workers compensation premiums are based mainly on the classifications that apply to a business’s workers. For example, office workers are classed with low rates; roofers with high rates. During the pandemic, however, many workers, including those in higher risk classifications with high rates, are not engaged in those activities.

The Department of Fair Employment and Housing provides free online training courses on preventing sexual harassment and abusive conduct in the workplace that satisfy California’s legal training requirements pursuant to Gov’t Code 12950.1. California law requires all employers of 5 or more employees to provide 1 hour of sexual harassment and abusive conduct prevention training to nonsupervisory employees and 2 hours of sexual harassment and abusive conduct prevention training to supervisors and managers once every two years. The law requires the training to include practical examples of harassment based on gender identity, gender expression, and sexual orientation.

The Acquired Business Exits Chapter 11 Bankruptcy Proceeding • Steve Andrews Named President and Chief Executive Officer. Briggs & Stratton, a recognized global leader in providing power to get work done, announced today that KPS Capital Partners, LP (“KPS”), through a newly formed affiliate, has acquired substantially all of the assets of Briggs & Stratton Corporation and certain of its wholly-owned subsidiaries (collectively, “Briggs & Stratton”, the “Company” or the “Acquired Business”). KPS acquired the assets free and clear of substantially all liens, claims, encumbrances and interests through a sale under Section 363 of the United States Bankruptcy Code. The U.S. Bankruptcy Court for the Eastern District of Missouri formally approved the transaction on September 15, 2020. With the completion of the sale to KPS, the Acquired Business has successfully exited from its Chapter 11 Bankruptcy proceeding.

White Cap Supply Holdings, LLC ("White Cap") and Construction Supply Group (“CSG”) announced the successful separation of White Cap from HD Supply and its combination with CSG. The combined transaction, valued at approximately $4 billion and including an investment by Clayton, Dubilier & Rice (“CD&R”) funds, creates the leading North American distributor of a diverse mix of concrete accessories and specialty construction and safety products by revenues with more than $4 billion annually. Following the transaction, CD&R funds hold a 65 percent ownership interest in the combined company, and the prior shareholders of CSG, led by The Sterling Group, hold a 35 percent interest. CSG and White Cap have highly complementary product offerings and geographic footprints, aligned cultures and strong talent focused on providing exceptional customer service to professional contractors. John Stegeman, CEO of White Cap, and Alan Sollenberger, President of White Cap, will lead the combined business.

Rob Lapsley, chairman of Californians for Affordable and Reliable Energy (CARE), issued the following statement in response to the governor’s Executive Order banning affordable gas-powered cars in California: “From the last publicly available data, true zero-emission vehicle sales accounted for just 5.6 percent of California vehicle sales. Clearly, despite significant incentives and repeated attempts to create a market by regulations from California Air Resources Board over the past three decades, Californians are still not choosing electric vehicles. Costs remain too high, charging infrastructure remains too sporadic and, now, there’s no guarantee there will be reliable electricity available to charge an onslaught of new cars putting even more pressure on the grid. Today, the governor stood in front of electric cars costing more than $50,000 and told millions of unemployed Californians that affordable cars will no longer be available for purchase in just 15 years. In 2019, 2.3 million Californians were forced into poverty because of California’s high cost of living, driven in part by expensive mandates increasing energy costs on all residents. There are ways we can achieve our emissions goals without forcing even more families into poverty or out of this state entirely.”
Senate Bill 1159 was recently passed by the California Legislature and signed by Governor Newsom. The bill establishes a rebuttable or disputable presumption for certain COVID-19 workers' compensation claims. In essence, a claim can be rebutted by evidence that the employee developed his or her illness due to exposure outside of the workplace. The bill became effective on September 17, 2020, when Governor Newsom signed it, and it will sunset on January 1, 2023. Matthew J. Roberts; J.D.; Employment Law Counsel/Subject Matter Expert for the CalChamber, reported on a recent California Court of Appeal's decision concerning an employment arbitration agreement. On August 26, 2020, the California Court of Appeal, Second District, reversed a trial court ruling invalidating an employment arbitration agreement contained within an employer’s employee handbook. The case highlights how important it is that employers use well-crafted acknowledgements when distributing new or revised employee handbooks, or even when updating important policies (Conyer v. Hula Media Services, LLC, et al., No. B296738 (Aug. 26, 2020)).
Michelle Galbraith, J.D.; HR Adviser, CalChamber, recently reported on liability for back wages. In the mid-1800s, a new form of industry arose that allowed corporations to minimize labor expenses while also limiting their exposure to liability for unsafe workplaces: the sweatshop. Corporations would hire a middleman — a “sweater” — to supervise workers who labored in poor conditions for very low wages. “By contracting with a ‘sweater’ to employ the workers, corporations were able to distance their brands from the unseemly conditions,” said Erika Frank, vice president of legal affairs and general counsel for CalChamber, “and of course protect their bank accounts from liability for the illegal labor practices that supported their operations.”
U.S. distillate fuel oil inventories remained high through summer 2020 as a result of production outpacing demand, which continues to be affected by responses to the 2019 novel coronavirus disease (COVID-19). Although about two-thirds of distillate in the United States is consumed for on-highway use each year, demand typically increases during the fall harvest (October–November) in the agriculture sector and during the winter heating season (October–March) in the residential sector. The U.S. Energy Information Administration (EIA) expects that increased demand in these sectors will help to draw down high U.S. distillate inventories, but inventories are still likely to remain higher than the five-year (2015–19) average throughout most of the upcoming winter season. EIA forecasts that high inventories and lower crude oil prices will continue putting downward pressure on diesel prices through the 2020–21 winter season.
