The Diamond Jubilee Gala will celebrate CRA and the loyal members who work to provide resources and services throughout the rental industry. The event will be held Jan. 25 at 6 p.m. in the Sonoma Room, South Point Casino, and will feature:

To better understand course-of-employment rules, it helps to look at the exceptions. When someone gets injured on the job, the connection — or nexus — between the job and the injury is usually clear and indisputable. But sometimes, it’s not. For instance, say you work at home and tripped over your dog while on the way to pull some fabric samples down from a shelf to take with you to a customer? Just such a claim was at first denied by the workers’ compensation judge but then paid on appeal. Exactly what does course of employment mean? We can probably understand the concept better by looking at the exceptions.

The California Air Resources Board has approved a smog-check regulation for medium- and heavy-duty trucks and buses. While these heavy-duty vehicles with a gross vehicle weight rating (GVWR) greater than 14,000 pounds comprise only 3% of all vehicles on California roads, they are responsible for more than 50% of nitrogen oxides and fine-particle diesel pollution from all mobile sources in the state. The action taken by CARB today will cover roughly 1 million heavy-duty trucks and buses operating in California. The twice-a-year inspections will ensure that the emissions control systems maintain the same efficiency as the vehicle ages. By 2037, the program is estimated to deliver reductions of 82 tons per day of NOx and fine-particle diesel pollution. The Board also directed a four-times per year testing frequency for trucks with on-board diagnostics to be phased in over time.
The California Air Resources Board has released its analysis of cost estimates for lengthened warranties required under the new Heavy-Duty Low NOx Omnibus Regulation. The regulation went into effect at the end of 2021 and is a key part of California’s Mobile Source Strategy for improving public health by reducing air pollution from the transport sector. The purpose of longer warranty periods for emission control-related equipment on heavy-duty trucks is to better ensure they perform as intended for the hundreds of thousands of miles trucks are typically driven. The new report released by CARB provides analysis of cost estimates for longer warranties required for the emissions-reduction equipment used in 2024 model year and later heavy-duty vehicle engines. The report is in response to board direction to staff given when the board approved the regulation in August 2020. CARB staff’s original warranty cost estimates were challenged by the Engine Manufacturers Association, and the board directed staff to form a working group to review their estimates in comparison to industry estimates.
In an effort to regulate and reduce emissions from medium- and heavy-duty vehicles in Washington, the Washington State Department of Ecology adopted the Advanced Clean Trucks Rule (ACT) to require truck makers to sell an increasing number of clean, zero-emission vehicles in the state. The department also adopted the Zero Emission Vehicle Program, which directs light-duty vehicle manufacturers to increasingly sell zero-emission vehicles in Washington. Starting in 2024, the program will result in zero-emission vehicles making up 8% of all light-duty vehicle sales, according to the department. Earlier this month, Oregon became the first state to adopt the ACT Rule after California. All West Coast states now have regulations in place requiring the sale of clean, zero-emission light-, medium- and heavy-duty vehicles.

Here’s a cautionary tale for California politicians who think voters will forever tolerate rising taxes as Sacramento swims in budget surpluses. In 1978, virtually every political institution in California opposed Proposition 13, including big business, labor, local governments and education advocates. Then voters stunned the elite political class by enacting the iconic tax-cutting initiative, a constitutional amendment that legislators couldn’t touch, by nearly a two-thirds vote. The passage of Proposition 13 was driven by both fear and anger. The fear that motivated voters to the polls is easy to understand. Although unthinkable today — thanks to the security provided by Prop. 13 — in the mid-70s' homeowners were literally being driven out of their homes by high property taxes. Howard Jarvis himself witnessed a despondent widow plead her case at the public counter in the L.A. County Assessor’s office where, regrettably, she collapsed and died of a heart attack.

A little-known fact about Howard Jarvis is that, long before achieving fame as the author of Proposition 13, he ran for the U.S. Senate in 1962. According to those who knew him, he promised that, if elected, he would put a big sign on the door of his Senate office with the single word “NO” in capital letters. That word capsulized his view on government spending and government in general. Not surprisingly, as the taxpayer organization founded by Jarvis, we continue with the tradition of saying no to higher taxes, more debt and bigger government. In fact, most of what we do is to oppose what happens in Sacramento. Nonetheless, and in the spirit of the past holiday, we’d like to take a few moments to shed our Scrooge persona and acknowledge a few of the good things we’ve seen from our political ruling class and media.
