Hawthorne Cat, the exclusive Cat® equipment dealer in San Diego, the Hawaiian Islands and the Pacific region, is sad to announce the passing of James Thomas “Tom” Hawthorne on March 10, 2022, at the age of 93. Along with his father, J.B. Hawthorne, Tom founded Hawthorne Machinery Co. in 1956. He led the company as its CEO for the next 50 years. Tom was always looking for new business opportunities and ways to grow and improve the company. He believed that helping a customer succeed in growing his own business should be goal No. 1. Tom was recognized as an icon in the construction markets and as a pioneer in the short-term equipment rental business (Hawthorne Rentals). He was also one of the first Cat dealers to establish a separate and dedicated Power Systems business unit (Hawthorne Power Systems). His 50-year career as a Caterpillar tractor dealer in San Diego, Hawaii, Guam and the Pacific Islands has been stellar.
Hawthorne Cat is in its third and fourth generation of leadership with Tom’s son-in-law, Tee Ness, as Chairman and grandson, Dave Ness, as President/CEO. Tom’s legacy of a commitment to excellence lives on through programs such as the Tom Hawthorne Diesel Technology Center at Miramar College, which grants scholarships to students earning their degree in Diesel Technology, and the Hawthorne Veteran and Family Resource Center, which is sponsored by Interfaith Community Services and is designed to help homeless veterans stabilize their lives. In his retirement, Tom started a new company called Tool Shed Equipment Rental & Sales with his brothers Paul, Jack and Gary Hawthorne. CRA’s next Fourth Wednesday Rental Workshop will take place via Zoom on April 27, 2022, from 2:30-4 p.m. A workshop titled “Reputation Management – Navigating the World of Online Sentiments” will be presented by Paige Sachs with ReachLocal.

More than half the states have legislated presumption bills that make workers' compensation claims from post-traumatic stress compensable for first responders.
Often when there is a particularly traumatic event, such as the 2018 school shooting in Parkland, Florida, a state will enact laws that presume a causal connection between the event and those who witnessed it who now suffer from post-traumatic stress injury or disability (PTSD). Many states have now enacted PTSD presumption laws for first responders — four more states just in the first week of February.
“With COVID, people are more amenable to the idea that mental injuries are a problem than (they have been) in the past,” said Tom Howard, an attorney at workers' compensation firm Gerber & Holder LLP, of Atlanta, told Business Insurance.
But it’s not just first responders who are prone to PTSD. Anyone in almost any job can get it.

Upcoming Deadline Reminder—Tier 2 Engines Owned by Small Fleets
This is a reminder of an upcoming deadline for Tier 2 engines registered in the Statewide Portable Equipment Registration Program (PERP) and owned by small fleets. Small fleets have a total cumulative horsepower of 750 brake horsepower (bhp) or less for all portable engines under common ownership and control of the fleet. The last postmark date PERP will accept low-use, or emergency-use, modification requests for registrations with Tier 2 engines built prior to January 1, 2009, rated at 50 bhp to 750 bhp, is July 1, 2022.

MS555: New Programs and Regulations at CARB – NEW
The California Air Resources Board (CARB) has several new regulatory programs that will help the State become carbon neutral in the future. These programs are going through the public process designed to get input from people and industries affected by the eventual requirements. The class will cover the requirements of existing regulations and then the new programs that will eventually be in effect. The goals for this class are to cover the proposed program elements and elicit participation in the regulatory process. These regulations are needed to meet federal and state ambient air-quality standards as well as mandated timelines for reaching carbon neutrality in California.
