March 1, 2018, the Governor General signed into law Bill S-2, commonly referred to as Vehicle Recall Legislation. After a year and a half of debate on this important legislation, our members applaud the government for passing this important consumer safety law. The RVDA supports this piece of legislation as it grants the power to order direct vehicle recalls to the federal Minister of Transport, aligning Canadian law with what has long been on the books in the United States.
Bill S-2 was introduced in the Senate by the Honourable Peter Harder, Leader of the Government in the Senate, and read for the first time on 11 May 2016. The bill was referred to the Standing Senate Committee on Transport and Communications on 25 October 2016. On 24 November 2016, the Committee reported the bill back to the Senate with an amendment (new section 10.52). The bill passed third reading in the Senate, as amended, on 2 February 2017.
RVDA supports the amendments to this bill made in the Senate which include:
- It ensures no new responsibilities or liabilities for dealers in the recall process;
- It ensures that manufacturers remained fully responsible for recalls, and;
- It contains a buyback provision – at dealer cost – when there is no fix under a recall situation. If you have any questions on Bill S-2 please feel free to contact Ashley Rensler at ashley@impactcanada.com.
