TIA has released an updated version of its model Broker-Carrier Contract to address the recent changing landscape of the California Air Resources Board (CARB) regulations on 3PLs and brokers. In addition to the model contract, the TIA Contracts Committee has put together a sample certification addendum to have your motor carriers sign. This is an important step to take when arranging transportation in California and one that CARB specifically recommends. Please take a few minutes to review the list of TIA Member Candidates for the month of October. If you have any information on why a Candidate should not be accepted into membership, please contact TIA immediately. Opposition or inquiries must be submitted in writing. A copy of the inquiry will be sent to the Candidate. On Sept. 30, 2018, it was announced that the U.S., Canada and Mexico have reach a trilateral agreement as part of the renegotiation of the North American Free Trade Agreement (NAFTA). The new agreement will be preliminary known as the United States-Mexico-Canada Agreement (USMCA). FMCSA Releases Advanced Notice of Proposed Rulemaking on Broker & Forwarder Financial Responsibility
On Sept. 27, 2018, the Federal Motor Carrier Safety Administration (FMCSA) published in the Federal Register an Advanced Notice of Proposed Rulemaking (ANPRM) on several aspects of the broker and freight forwarder financial responsibility. FMCSA announced that it is initiating a rulemaking pertaining to the implementation of the Moving Ahead for Progress in the 21st Century Act (MAP-21). MAP-21 raised the financial security amount for brokers to $75,000 and, for the first time, established financial security requirements for freight forwarders. On Sept. 28, the Federal Motor Carrier Safety Administration (FMCSA) published in the Federal Register a final rule that allows, but does not require, State Driver Licensing Agencies (SDLAs) to waive requirements for the commercial learner's permit (CLP) knowledge test for certain individuals who are, or were, regularly employed within the last year in a military position that requires, or required, the operation of a commercial motor vehicle (CMV). This rule includes the option for an SDLA to waive the tests required for a passenger carrier (P) endorsement, tank vehicle (N) endorsement, or hazardous material (H) endorsement, with proof of training and experience. The final rule takes effect on Nov. 27, 2018. Last week, TIA President and CEO Robert Voltmann, who also serves as FIATA Secretary General provided opening remarks to attendees of the FIATA World Congress in New Dehli, India. In his address, Voltmann decried the politicization of FIATA by the Indian government after it denied a visa to FIATA President Babar Badat of Pakistan.
