On September 25, the Wage & Hour Division of the Department of Labor published in the Federal Register a Notice of Proposed Rulemaking (NPRM) and request for comments on Independent Contractor Status under the Fair Labor Standards Act (FLSA). The DOL is revising its interpretation of independent contractor status under the FLSA in order to promote certainty for stakeholders, reduce litigation, and encourage innovation in the economy.
