Attorney Rick Alaniz addresses how employers can prepare for the likely increase in the salary threshold for overtime eligibility. Approximately 43 million U.S. workers are classified as “exempt” under the Fair Labor Standards Act (FLSA), meaning they are not entitled to overtime pay when working in excess of 40 hours in a work week. For a worker to be exempt, he/she must perform certain duties and be paid a salary above a certain threshold. In preparation for an increase in the eligibility threshold, employers should consider conducting a thorough review of the job duties of all salaried employees – more than merely identifying these employees whose salaries are below the proposed threshold. Ensuring that the employees’ duties are consistent with the exemption relied upon, irrespective of the salary threshold, is critical in avoiding potential misclassification liability. Texas State Board of Plumbing Examiners, acting on the authority granted by the legislature, has paved the way for students who successfully complete a high school/trade school program to immediately test to become licensed tradesman plumbers. Texas Workforce Commission's Jobs and Education for Texans (JET) Program supports those efforts by providing funds for training equipment supporting in-demand occupations like plumbing. The JET Program provides grants to public junior, state and technical colleges, open enrollment charter schools, and school districts to purchase and install equipment for the development of career and technical education courses or programs that lead to a license, certificate or postsecondary degree in a high-demand occupation.
