Recently, the VAA was contacted by Virginia’s Department of Labor and Industry about the Silica Regulation enforcement. While the Federal Occupational Safety and Health Administration (OSHA) has delayed the enforcement of the regulation until September 23, 2017, Virginia’s Occupational Safety and Health (VOSH) will begin enforcing the regulation on June 23. For construction activities covered under Table 1 of the regulation, contractors that adhere to Table 1 Control Methods will not be required to perform additional monitoring. If an activity is covered under Table 1 and the contractor does not follow the engineered control method, then a plan and respiratory monitoring is required. Summer is heating up and so is pavement recycling. This summer Virginia will continue to see full-depth reclamation and cold asphalt recycling projects. To learn more about these recycling techniques, how they are performed, and how they are accepted by specification, VECAT will be offering three new certification classes. These classes will utilize a combination of international industry experts, VDOT specifiers and VTRC researchers. Upon completion of the class and passing a certification exam, students will receive a VECAT certification. Each pavement recycling class is one day in length. Classes are August 1 (Full-Depth Reclamation), August 2 (Cold Asphalt Recycling Plant) and August 3 (Cold Asphalt Recycling Field) at the Germanna Community College Daniel Center Campus in Culpeper. My philosophy at VAA for the last thirty-five plus years has been just that; together you represent Virginia’s asphalt paving industry and you have the power to control your own destiny. VAA is excited to offer an opportunity to participate in a lab testing Round Robin. This will include a gyratory sample, a rice, and a furnace with gradation. All each lab has to do is run the appropriate tests and send the results back to the specified facility. Once all the test results are received, VAA will let each participant know how their results compared to the other laboratories in Virginia.

1. CITIZENS BOARDS.
The State Water Control Board met May 17.
a. E-Reporting Rule.
The Board approved DEQ’s proposed regulations incorporating the Electronic Reporting Rule into the VPDES Regulations (9 VAC 25-31) and VSMP Regulations (9 VAC 25-870). EPA’s Electronic Reporting Rule requires that all water permitting-related information be provided in electronic format and ultimately posted on the agency website. Note that this will eventually include all DMRs, annual reports, registration statements, and notifications of spills or upsets. DEQ is currently in discussions with EPA regarding how best to upload DMR submittals and DEQ is working on changes to its eDMR system. The Electronic Rule must be completely phased in by 2020.

Starting July 1, the new required sign on the back of construction dump trucks will take effect. Please make sure trucks serving transportation construction projects display the sign "Work Vehicle Frequent Turns."

VDOT has developed a new Flagger Training video and has revised the Flagger Training Materials. The new video can be found on YouTube: VDOT: Flagger Training. The video replaces the flagger certification training video which was produced by VDOT in 2007. Revised Flagger Training material based on the new video is available from ATSSA, use this Order Form. The revised training material replaces the 2009 training material. VDOT encourages you to view the new Flagger Training video so you can apply its information in the field. When your current Flagger Certification expires, the new material shall be used to become re-certified in flagging.
