With the rise of online websites claiming to provide verifications and
blurring lines between those meeting the legal definition of disabled
and those not, apartment professionals must exercise caution and take
the necessary steps to insure those entitled to an accommodation receive
it while those simply trying to game the system do not.
Blurred lines seem to be the new norm as HUD's guidance on criminal background screening brings more variables into question than it answers when screening potential residents. As part of our discussion we also reviewed HUD's new guidance, the disparate impact theory behind it and discussed best practices our members can implement to steer clear of problems.
