Trends and legislative agendas indicate that employers will face some new challenges in 2022 while battling old ones. When possible, it is critical that businesses prepare for these changes in advance of implementation. Below are some major regulatory and compliance trends we are watching. as well as some actions we recommend taking throughout the year.
Did you know that over 70% of the nation's roads are located in snowy regions, and that nearly 70% of the U.S. population lives in those regions? This is according to the Federal Highway Administration, which also reports that 24% of weather-related vehicle crashes occur on snowy, slushy or icy pavement, causing over 1,300 deaths and 116,000 injuries each year.

AO 12142: NCCI Item Filing B-1444 – NCCI’s Basic Manual for Workers Compensation and Employers Liability Insurance was approved by Administrative Order 12142 for policies effective on or after November 1, 2021. The 2021 Basic Manual has a modernized format. Rules and values are arranged by topic. This helps to make future customer use easier. NCCI advised this manual does not make any substantive changes to any rule or classification that would result in premium impact.
AO 12145: Effective September 1, 2022 (new business) and September 1, 2022 (renewal business) –AIPSO Filing No. VA 21-14 added forms for Commercial Auto as listed in the Administrative Order, withdrew CA 99 34 10 13 – Social Service Agencies – Volunteers as Insureds and CA 05 23 03 18 - Virginia Employee Hired Autos, revised load capacity of 2,000 pounds to 3,000 for Rule 74, amended Rule 125 - Non-owned Auto Liability and deleted Rule 126 - Partnership as the Named Insured-Non-ownership Liability.
AO 12146: Effective September 1, 2022 (new business) and September 1, 2022 (renewal business) – AIPSO Filing No. VA 21-15 makes amendments to Sections 17-19, 21-23, 26, 30-32, 35, 43, 44, 46, and 47 of the Plan Manual for Commercial Auto to facilitate the transition of the countrywide CAIP servicing carrier with a countrywide service provider.
According to CoreLogic's 2021 Climate Change Catastrophe Report, the U.S. saw nearly $57 billion in damage due to extreme weather. The report found reconstruction costs have shown a meaningful increase over the last two years. This has left homeowners and insurers alike struggling to keep up as extreme catastrophic weather events increase in frequency and impact.
A North Carolina motorcyclist who lost a leg after a collision with an Amazon delivery truck has filed a lawsuit arguing that unrealistic expectations for the tech giant’s delivery drivers have led to negligence. According to his lawsuit, filed in Norfolk, Virginia, Circuit Court in January, Justin Hartley was riding his motorcycle in Virginia Beach on Oct. 4 when a rented truck with an Amazon logo turned directly into his lane, The Virginian-Pilot reported.

VCU's Risk Management & Insurance Program announces Faith Cringe as their 2022 Spencer Foundation Risk Manager on Campus from March 21 to March 23, 2022. During Ms. Cringe’s visit, VCU's RMI Program will host a breakfast at the County Club of Virginia on Wednesday, March 23, 2022, from 8:30 to 10 a.m.
