VDOT Issues Requested Clarification on DBE/SWaM Reporting

The Virginia Department of Transportation has clarified their requirements for reporting of SWaM and DBE participants on consultant contracts. VTCA recently requested that VDOT address the inconsistent DBE/SWaM reporting requirements between the consultant procurement and contractor programs. In response, the Department has issued guidance bringing the reporting requirements on consultant contracts in line with construction contracts.

VDOT has been engaged in reviewing the questions of goal reporting for firms that are certified as both DBE and SWaM. Based upon this review and agreement by FHWA, the VDOT application of DBE/SWaM participation has changed.

Participation by consultants or subconsultants certified by DSBSD as a Disadvantaged Business Enterprise (DBE) will be reported pursuant to the Department's DBE regulations and participation by consultants or subconsultants certified by DSBSD as "small businesses" shall include, but not be limited to, small, any subcategory of small, small women-owned, small minority-owned, or small service disabled veteran-owned businesses (SWaM) will be reported pursuant to Executive Order 35. This will also hold true for the subset of subcontractors who are certified as both DBEs and SWaMs, where any work performed by such subconsultants will be reported to both programs.
