VPDES General Permit for Nonmetallic Mineral Mining

Over the past two years, DEQ has been working on the required periodic review and renewal for the Virginia Pollutant Discharge Elimination System (VPDES) General Permit Regulation for Nonmetallic Mineral Mining 9 VAC 25-190. The existing permit is scheduled to expire on June 30, 2024 and will be replaced with the revised general permit.
VTCA’s Aggregates Environmental Committee has worked closely with DEQ on the drafts of the revised general permit. The review and renewal process are in the final stage, and the final draft of the proposed permit is before the governor for his signature. The full proposed text can be found here.
Some of the revisions include relief in dewatering pits that have become flooded due to significant storms (Part I - Effluent Limitations, Monitoring Requirements, and Special Conditions – #18). The other significant revision is that DEQ will request registration statements be filed electronically.
DEQ is reminding permit holders that coverage under the Virginia Pollutant Discharge Elimination System (VPDES) General Permit Regulation for Nonmetallic Mineral Mining (9VAC25-190) expires June 30, 2024. The deadline to submit a complete registration statement (including receipt and deposit of the registration fee) for continuation of coverage is May 1, 2024.
