On January 22, the SPFA Board of Directors unanimously approved creation of the Geotechnical Applications Committee. This new technical committee will focus on SPF applications that include concrete lifting (“slab jacking”), soil stabilization for excavation, mining and underground piping, infrastructure repair and other non-insulation applications of SPF. SPFA has joined coalition of roofing trade associations representing contractors, manufacturers, distributors and consultants to encourage workers to be vaccinated when possible. Vaccinations, along with proper workplace practices, will help maintain essential worker status for construction workers. Many challenges and opportunities abound for contractors as the pandemic and pent-up demand outline 2021. While the Equal Opportunity Employment Commission, as well as a panel of construction lawyers, recently determined that employers could require workers to be vaccinated with certain exceptions, the implications of forcing workers who object to get inoculated over potential safety concerns is sure to be a challenge for contractors in 2021.

Under the Executive Order on Protecting Worker Health and Safety signed January 21, the president has directed OSHA to “consider whether any emergency temporary standards (ETS) on COVID-19, including with respect to masks in the workplace, are necessary, and if such standards are determined to be necessary, issue them by March 15, 2021.” This order also directs OSHA to work with the Centers for Disease Control and Prevention (CDC) to develop guidance for all employers by February 4. In addition, an OSHA National Emphasis Program (NEP) will be implemented to “focus OSHA enforcement efforts related to COVID-19 on violations that put the largest number of workers at serious risk or are contrary to anti-retaliation principles.” This order is included into the Biden Administration’s National Strategy for the COVID-19 Response and Pandemic Preparedness, Biden emphasized the priority his Administration plans to place on OSHA enforcement programs during his presentation of this strategy.
